1. Acceptance

By submitting an application to Holiday Lights Inc (“the Company,” “we,” “us”) through any of our
application channels – our careers website, our hosted career page, an applicant tracking system we
use, a job board, text message, or in person – you agree to these Application Terms and Conditions
and to our Applicant Privacy Policy.

2. No offer of employment, no guarantee of interview or hire

Submitting an application does not create an offer of employment, a promise of an interview, or any
contract between you and the Company. We decide who advances at each stage of our hiring process at
our discretion. We may fill a position, change a position, or decide not to fill it at all, at any
time and without notice to applicants.

Nothing on our careers website, in a job posting, in a recruiting message, or in an interview
creates a contract of employment or a promise of continued employment.

3. Employment is at will

If we hire you, your employment with the Company is at will. That means either you or the Company
may end the employment relationship at any time, with or without cause and with or without notice.
Seasonal roles are additionally limited by the season itself: the work has a defined start and a
defined end, and the end of the season ends the job.

No manager, recruiter, or other Company representative has authority to change the at-will nature
of employment, or to promise employment for a fixed period, except in a written agreement signed by
an officer of the Company.

4. Accuracy of the information you give us

You represent that the information in your application, your video audition, and any other material
you give us is true, complete, and your own work. You agree that if we discover any false
statement, omission, or misrepresentation, we may end your application at any point in the process,
or, if you have already been hired, end your employment.

5. How we will contact you, including by text message

Our hiring process runs on text messaging. We text you first, usually the same day you apply.

By submitting an application and giving us your phone number, you agree that the Company and the
people recruiting for it may contact you by phone call, text message (SMS), and email about your
application, your interview, your onboarding, and the job you applied for. This includes messages
sent by an automated system.

This consent covers messages about your application and your employment. It is not consent to
marketing about our light installation services.

6. Age and eligibility

You must be at least 18 years old to apply. You must be legally authorized to work in the United
States. If hired, you will be required to complete a Form I-9 and provide documentation of your
identity and work authorization.

7. Door-to-door sales roles: county permit and criminal background check

This section applies if you are applying for a door-to-door outside sales role.

Florida law requires a home solicitation sale permit for the person doing the soliciting, issued by
the Clerk of Court in the county where you will be knocking. Some cities require a second permit.
Getting that permit is a condition of working this job.

You should know the following before you apply:

  1. You apply for the permit yourself. The county issues it to you personally, not to the
    Company. We will give you the forms, the fee amounts, and step-by-step instructions, and we
    reimburse the fees under the terms stated in your offer letter.
  2. The permit process includes a criminal background check and fingerprinting. The Florida
    Department of Law Enforcement and the county sheriff’s office run that check. You submit your
    fingerprints and your information to them directly, through the county process. The Company does
    not run this check and does not receive your fingerprints.
  3. Certain criminal history can disqualify you from holding the permit. The statute lists
    grounds on which a county may deny a permit. If you cannot be permitted, you cannot work a
    door-to-door role for us, because the permit is a legal requirement of the work.
  4. Timing is not fully within our control. State and county agencies control how long the
    background check and permit approval take.

8. Video auditions and other material you send us

Part of our hiring process asks you to record and send a short video of yourself delivering our
door opener script. Sending it is voluntary, and it is part of how we evaluate applicants.

By sending us a video, a recording, or any other material, you grant the Company permission to
store, view, and share it internally for the purpose of evaluating your application. We do not
publish applicant videos, use them in advertising, or share them outside the Company’s hiring
process without your separate written permission.

Do not include anything confidential to a current or former employer.

9. How long your application stays active

We consider your application active for the current hiring season. After that, we may keep it on
file and contact you about future seasons unless you ask us not to.

11. Earnings

Any earnings figures in our job postings or recruiting material are stated with their conditions.
Commission earnings depend on individual effort, hours worked, results, and market conditions, and
they are not guaranteed. Your pay, if we hire you, is governed only by the written offer letter and
commission plan you sign.

12. Changes to these terms

We may update these Application Terms and Conditions. The version posted at the time you submit an
application governs that application.

13. Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict of law
rules.
